Terms and conditions of the contest – 134 years
ARTICLE 1 – SOCIETE ORGANISATRICE
La société Bal du Moulin Rouge (ci-après « la Société Organisatrice »), société anonyme au capital de 4.515.676 Euros, dont le siège est situé 82, boulevard de Clichy à 75018 Paris, immatriculée au Registre du Commerce et des Sociétés (RCS) de Paris sous le numéro de SIRET 552 046 120, organise du vendredi 29 septembre 2023 inclus au vendredi 6 octobre 2023 inclus un jeu-concours intitulé « Jeu – concours 134 ans », gratuit et sans obligation d’achat avec tirage au sort (ci-après « le Jeu »), par l’intermédiaire d’Instagram et de Tik-Tok via les publications disponibles aux adresses https://www.instagram.com/moulinrougeofficiel/ et https://www.tiktok.com/@moulinrougeofficiel et selon les modalités du présent règlement, accessible via le lien suivant : https://www.moulinrouge.fr/reglement-du-jeu-concours-134-ans/.
Le Jeu n’est ni parrainé ni géré par Instagram ni Tik-Tok. Tous commentaires, questions ou réclamations concernant le Jeu devront être adressés à la Société Organisatrice et non à Instagram ou Tik-Tok. Les informations communiquées par les participants sont fournies à la Société Organisatrice et non à Instagram ou Tik-Tok.
ARTICLE 1 – ORGANIZING COMPANY
The company Bal du Moulin Rouge (hereafter referred to as “the Organizing Company”), a public company with a capital of 4,515,676 Euros, whose head office is located at 82, boulevard de Clichy 75018 Paris registered at the Registre du Commerce et des Sociétés (RCS) of Paris under the business identification (SIRET) number 552 046 120, organizes from Friday, September 29th 2023 included to Friday, October 6th 2023 included, a free random draw game contest entitled “ Contest 134 years” with no purchase necessary (hereinafter referred-to as “the Game“) via the posts available at the following links https://www.instagram.com/moulinrougeofficiel/ and https://www.tiktok.com/@moulinrougeofficiel and in accordance with the terms and conditions of the present rules, accessible via the following link: https://www.moulinrouge.fr/reglement-du-jeu-concours-134-ans/.
This Game is neither sponsored nor managed by Instagram or Tik-Tok. Any comment, question or complaint in relation with the Game should be addressed to the Organizing Company and not to Instagram or Tik-Tok. The information communicated by participants are shared with the Organizing company, not with Instagram or Tik-Tok.
ARTICLE 2 – CONDITIONS DE PARTICIPATION
Le Jeu est ouvert à toute personne physique âgée de plus de 18 ans, de toutes nationalités et sans restriction de territoires, disposant d’un accès à internet et d’un compte Instagram et/ ou Tik-Tok valide, à l’exception du personnel de la Société Organisatrice et de leurs familles, ainsi que de toute personne ayant participé à l’élaboration du Jeu. La Société Organisatrice se réserve le droit de demander à tout participant de justifier de ces conditions. Toute personne ne remplissant pas ces conditions ou refusant de les justifier sera exclue du Jeu.
Les participants sont autorisés à jouer plusieurs fois au Jeu, sur un réseau social ou les deux.
Le Jeu est soumis à la réglementation de la loi française applicable aux jeux et concours.
Le seul fait de participer au Jeu implique l’acceptation pure et simple, sans réserve, du présent règlement. Le non-respect dudit règlement entraine l’annulation automatique de la participation et de l’attribution éventuelle du gain.
ARTICLE 2 – CONDITIONS OF THE PARTICIPATION
The Game is open to any person over 18 years of age, of all nationalities, who has access to the Internet and a valid Instagram and /or Tik-Tok account, without territory restrictions, with the exception of the staff of the Organizing Company and their families, as well as, anyone involved in the development of the Game. Any person who does not meet the conditions or refuses to justify that they are fulfilled will be excluded from the Game.
Participants are allowed to play several times in the Game, either on one or both social medias.
The Game is subject to the regulation of French law applicable to games and contests.
The mere fact of participating in this game implies the full and unreserved acceptance of these rules.
Non-compliance of the present rules leads to the automatic cancellation of the participation and of the possible allocation of a prize.
ARTICLE 3 – MODALITES DE PARTICIPATION
La participation au Jeu se fait exclusivement via les comptes Instagram et Tik-Tok officiels du Moulin Rouge (@moulinrougeofficiel et @moulinrougeofficiel) pendant la période indiquée à l’article 1.
Pour être éligible au tirage au sort sur chacun de ces réseaux sociaux, il vous suffit de :
– Suivre le compte officiel du Moulin Rouge
– Aimer la publication relative au Jeu
– Identifier un(e) ami(e) en commentaire de la publication
ARTICLE 3 – TERMS OF PARTICIPATION
The Game takes place exclusively on the official Instagram and Tik-Tok accounts of the Moulin Rouge (@moulinrougeofficiel et @moulinrougeofficiel) during the period indicated in article 1.
Participation in the draw, for each social media, is done by:
– Following the official account of the Moulin Rouge
– Liking the post about the Game
– Identifying a friend in comment of the said post
ARTICLE 4 – DESIGNATION DU GAGNANT
Le tirage au sort se déroulera le vendredi 6 octobre 2023 à 15h (heure française) et désignera deux (2) gagnants au sort (un (1) gagnant sur chaque réseau social) parmi les participants remplissant les conditions précitées à l’article 3 du présent règlement.
Les gagnants seront contactés par la Société Organisatrice dans un délai de sept (7) jours après le tirage au sort afin d’obtenir leurs coordonnées complètes (nom, prénom, adresse, téléphone, email) indispensables à l’attribution de la dotation. Les gagnants seront notifiés de leur gain via la messagerie privée rattachée à leur compte Instagram ou Tik-Tok, ce que chaque participant accepte expressément. A cet égard, la Société Organisatrice ne pourra être tenue pour responsable de l’envoi du message sur un compte inexact du fait d’une erreur de la part du participant, ni du dysfonctionnement du dispositif d’envoi du message.
Les gagnants auront droit à un lot dans les conditions visées à l’article 5 du présent règlement.
En l’absence de réponse de la part du gagnant dans un délai de quinze (15) jours à compter de la notification sur son compte, la Société Organisatrice se réserve le droit de remettre en jeu le gain dudit gagnant en procédant à un nouveau tirage au sort.
ARTICLE 4 – IDENTIFICATION OF THE WINNER
The random draw will be held on Friday, October 6th, 2023 at 3PM (French time) and will determine two (2) winners at random (one (1) on each social media) amongst the participants who fulfilled all the terms of participation presented under article 3 of these rules.
The winners will be contacted within seven (7) days after the draw by the Organizing Company in order to obtain full contact details (surname, name, address, phone number and email) necessary for the prize delivery. The winners will receive a notification via the private messaging account associated with their account on Instagram or Tik-Tok, and agree to it. The Organizing Company cannot be held responsible for sending a notification to an address which is incorrect due to a mistake made by the participant, or for the dysfunction of the message sending system.
The winner wins the prize in the terms defined under article 5 of these rules.
If the winner does not respond within fifteen (15) days after receiving the notification via their account, he or she will be deemed to have forfeited the prize and a new random draw will be held.
ARTICLE 5 – DOTATION
Les gagnants tirés au sort remporteront chacun les lots suivants :
– une invitation pour deux (2) personnes pour une soirée diner-spectacle au Moulin Rouge, d’une valeur commerciale de 550 Euros TTC unitaire ; ce lot comprend deux (2) diners Toulouse-Lautrec à 19h suivi du spectacle « Féerie » de 21h à la date de leur choix et suivant les places disponibles (à l’exception du 24 et 31 décembre 2023). Cette invitation sera valable pour une durée d’un (1) an, soit jusqu’au 6 octobre 2024. Ce lot ne comprend ni le transport ni l‘hébergement.
– une visite exclusive des coulisses du Moulin Rouge en amont du spectacle.
La dotation ne pourra en aucun cas être échangée contre sa valeur en espèces ou contre toute autre dotation.
La valeur indiquée pour les lots correspond au prix public TTC à la date de rédaction du règlement. Elle est donnée à titre indicatif et est susceptible de variation.
La Société Organisatrice se réserve le droit de remplacer la dotation par une autre dotation équivalente quant à sa valeur et caractéristiques, pour quelque cause que ce soit, sans que sa responsabilité puisse être engagée à cet égard.
ARTICLE 5 – PRIZE
The winners will each win the following prizes:
– Prize 1: one invitation for two persons for a “Toulouse-Lautrec Evening” (Dinner and Show) at the Moulin Rouge, of a commercial unit value of 550 Euros; this dotation comprises two (2) dinners Toulouse Lautrec 7PM followed by the show “Féerie” at 9PM at the Moulin Rouge for the date of their choice and according to availabilities (except for December 24th and 31st, 2023). This invitation will be valid for one (1) year, that is to say until October 6th, 2024. This prize does not include transportation or accommodation;
– an exclusive visit backstage of the Moulin Rouge, before the beginning of the show.
The endowment will in no case be exchanged for its value in cash or any other prize.
The value indicated for the prizes corresponds to the public price including tax at the date of drafting the rules. It is given as an indication and is subject to variation.
The endowment will in no case be exchanged for its value in cash or any other prize.
The Organizing Company reserves the right to replace any prize with another prize equivalent in value and characteristics, for any reason whatsoever, without its liability being incurred in this respect.
ARTICLE 6 – ACHEMINEMENT DES LOTS
Moulin Rouge prendra en charge, le cas échéant, les frais relatifs à l’acheminement des lots. Toutes précisions complémentaires et tous renseignements pratiques seront donnés en temps utile aux gagnants.
En aucun cas, la Société Organisatrice ne saurait voir sa responsabilité engagée au titre d’un quelconque retard dans l’acheminement des lots qui sera de la seule responsabilité contractuelle ou légale revenant au prestataire désigné à cet effet par la Société Organisatrice.
Dans l’hypothèse où un gagnant ne souhaiterait pas, ou n’était pas en mesure, pour quelque raison que ce soit, de bénéficier de son lot dans les conditions décrites dans le présent règlement, il perdra le bénéfice complet dudit lot et ne pourra prétendre à une quelconque indemnisation en contrepartie.
ARTICLE 6 – PRIZES DELIVERY
Moulin Rouge will pay, where applicable, the cost of shipping. Any additional precisions and practical information will be communicated to the winners in due time.
Under no circumstances shall the Organizing Company be held liable for any delay in the delivery of the prizes, which shall be the sole contractual or legal responsibility of the service provider designated for this purpose by the Organizing Company.
In the event that a winner does not wish to, or is unable, for any reason whatsoever, to benefit from his/her prize under the conditions described in these rules, he/she shall lose the full benefit of said prize and shall not be entitled to claim any compensation whatsoever in return.
ARTICLE 7 – DONNEES A CARACTERE PERSONNEL
Il est rappelé que pour participer au Jeu, les participants doivent nécessairement fournir certaines informations personnelles qui sont enregistrées et sauvegardées dans un fichier informatique comme nécessaires à leur participation au Jeu et au tirage au sort ainsi qu’à la remise du lot au gagnant. L’absence de ces informations rend impossible la participation au Jeu et l’attribution de la dotation.
Ces informations sont destinées à la Société Organisatrice et pourront être transmises à ses prestataires techniques.
Ces données personnelles sont collectées aux seules fins de participation au Jeu et au tirage au sort, ainsi qu’à l’attribution de la dotation.
Conformément aux dispositions de la loi « Informatique et Libertés » n°78-17 du 6 janvier 1978 modifiée, les participants bénéficient d’un droit d’accès, de rectification et de suppression, ainsi que d’un droit de s’opposer ou de solliciter la limitation du traitement des données les concernant en adressant à la Société Organisatrice une demande en ce sens par courrier à l’adresse suivante : Bal du Moulin Rouge, Jeu-concours 134 ans, 82 boulevard de Clichy, 75018 Paris.
En cas d’exercice du droit d’opposition avant la fin du Jeu, le participant renonce à sa participation.
ARTICLE 7 – PERSONAL DATA
It is reminded that in order to participate in the Game, the participants agree in advance to convey to the Organizing Company a certain amount of personal data which are registered and saved in a dedicated database, necessary for the participation in the Game, for the random draw as well as for the delivery of the prize to the winner.
This information is intended for the Organizing Company and can be shared with technical service providers.
This information is gathered for the sole purpose of participating in the Game and in the random draw, as well as in the delivery of the prize. In accordance with the French data protection legislation of 6 January 1978 (“Informatique et Libertés”n°78-17) as amended by the law of 6 August 2004, participants benefit from a right of access, rectification and deletion, as well as a right to oppose or request the limitation of the processing of data concerning them by addressing the Organizing Company at this address: Bal du Moulin Rouge, Game Contest « Contest 134 years», 82 boulevard de Clichy, 75018 Paris.
In case the opposition right is used before the end of the Game, the participant waives their participation to the Game.
ARTICLE 8 – MODIFICATION ET ANNULATION DU JEU
La Société Organisatrice se réserve la faculté d’annuler, d’écourter, de prolonger, de suspendre, de modifier ou de reporter le Jeu à tout moment si les circonstances l’exigent, sans que sa responsabilité puisse être engagée. Dans la mesure du possible, ces modifications ou changements feront l’objet d’une information préalable par tous moyens appropriés.
Si une ou plusieurs dispositions du présent règlement étaient déclarées nulles ou inapplicables, les autres clauses garderaient toute leur force et leur portée.
ARTICLE 8 – MODIFICATION OR CANCELLATION OF THE GAME
The Organizing Company reserves the right to cancel, shorten, extend, suspend, modify or postpone the Game at any time in case of absolute necessity, without liability. As far as possible, these modifications or changes will be spread by all appropriate means.
If one or more provisions of this regulations are declared void or non-applicable, the other provisions remain in force.
ARTICLE 9 – REGLEMENT DU JEU
Le règlement peut être consulté et téléchargé sur la page du Jeu concours développée pour l’occasion à l’adresse : https://www.moulinrouge.fr/reglement-du-jeu-concours-134-ans/. Il est également adressé, à titre gratuit, à toute personne qui en fait la demande auprès de la Société Organisatrice, qui s’engage à rembourser sur demande expresse le timbre au tarif lent en vigueur de la demande de communication du règlement à l’adresse suivante : Bal du Moulin Rouge, Jeu-concours 134 ans, 82 boulevard de Clichy, 75018 Paris.
Toute question d’application ou d’interprétation du règlement, ou toute question imprévue qui viendrait à se poser, sera tranchée souverainement par la Société Organisatrice.
ARTICLE 9 – RULES OF THE GAME
The rules of the Game can be viewed and downloaded from the contest page at this address https://www.moulinrouge.fr/reglement-du-jeu-concours-134-ans/. It can also be sent, free of charge, to any person who requests it from the Organizing Company, which undertakes to reimburse upon request the stamp at the current regular mail rate on specific request at this address: Bal du Moulin Rouge, Game Contest « Contest 134 years», 82 boulevard de Clichy, 75018 Paris.
Any question of application or interpretation of the rules, or any unforeseen question that may arise, shall be decided by the Organizing Company.
ARTICLE 10 – RESPONSABILITE
Il est expressément rappelé que l’Internet n’est pas un réseau sécurisé. La Société Organisatrice ne saurait donc être tenue pour responsable de la contamination par un éventuel virus ou de l’intrusion d’un tiers dans le système du terminal des participants au Jeu, et décline par avance toute responsabilité quant aux conséquences de la connexion des participants au réseau via les pages officielles de Moulin Rouge.
La Société Organisatrice ne saurait être tenue pour responsable de tout vol et perte intervenus lors de la livraison du lot, ni même de l’envoi de la dotation à une adresse inexacte du fait d’une erreur que le gagnant aura commise en indiquant ses coordonnées postales, ou d’une erreur imputable aux services postaux.
ARTICLE 10 – LIABILITY
It is expressively reminded that the Internet is not a safe network. As a consequence, the Organizing Company cannot be held liable for the contamination by a potential virus or the intrusion of a third party into the terminal system of the Game’s participants and declines in advance all responsibility as for the consequences of connecting to the Internet via the official pages of the Moulin Rouge.
The Organizing company cannot be held liable for any theft or loss occurring during the delivery of the prize, not even for the shipment of the prize to the wrong address due to a mistake made by the winner while transmitting their postal details or for a mistake attributed to postal services.
ARTICLE 11 – LITIGES
Toute contestation sur le Jeu devra être faite par lettre recommandée avec accusé de réception dans un délai de dix (10) jours à compter du terme du présent Jeu (cachet de la poste faisant foi) à l’adresse suivante : Bal du Moulin Rouge, Jeu-concours 134 ans, 82 boulevard de Clichy, 75018 Paris.
ARTICLE 11 – LITIGATION
Any dispute related to the Game is to be made by registered letter with an acknowledgement of receipt at the latest 10 days after the end of the Game at this address: Bal du Moulin Rouge, Game Contest « Contest 134 years», 82 boulevard de Clichy, 75018 Paris.
ARTICLE 12 – JURIDICTION
Le présent Jeu est soumis à la loi française. Tout litige qui ne pourra être réglé à l’amiable sera porté devant les tribunaux compétents de Paris.
