TERMS AND CONDITIONS - “INSTANT DRAW” GAME

ARTICLE 1 – ORGANIZING COMPANY
The company BAL DU MOULIN ROUGE, a limited company with a capital of 4,515,676 euros, whose head office is located at 82, boulevard de Clichy,75018 Paris under the business identification (SIRET) number 552 046 120, organizes from July 24th, 2023, to December 31st, 2023, a free raffle game contest with no purchase necessary called the “Instant Draw”(hereinafter referred to as “the Game“).

All the trademarks, logos and other distinctive signs reproduced on the Game, are the exclusive property of their owners and are protected by Intellectual Property Law. Any unauthorized reproduction of those trademarks, logos and signs constitutes an infringement liable to civil and criminal penalties.

The software used for the purposes of the Game as well as the texts, comments, illustrations or pictures reproduced on the website, and on those it allows the access to, are protected by copyright, and their unauthorized reproduction constitutes an infringement liable to civil and criminal penalties.

ARTICLE 2 – CONDITIONS OF PARTICIPATION
This free Game with no purchase necessary is open to any physical person over 18 years of age who owns an email address and uses the Game’s application from the digital tablets made available within the Moulin Rouge, with the exception of the personnel of the organizing company and its partners, their families and partners (marriage, P.A.C.S or marital life, recognized or not).

The persons who do not have a valid email address or who would have inadequately provided their personal details (civility, last name, first name, birth date, country, zip code and phone number if applicable, and email address) will be disqualified, as well as the persons refusing the collection and use of personal data which are strictly necessary for the purpose of the management of the Game.

The participation in the Game implies the entire and unreserved acceptance of these rules and regulation of French law applicable to games and contests. Non-compliance to the present rules will lead to the automatic cancellation of the participation and of the possible allocation of a prize.

ARTICLE 3 – TERMS OF PARTICIPATION
Participation in the Game takes place on the digital tablets available within the Moulin Rouge located 82, boulevard de Clichy, 75018 Paris.

To be eligible for the drawing lots, the User needs to indicate his/her personal details (civility, last name, first name, birth date, country, zip code and phone number if applicable and a valid email address), and fully accept the rules of the Game.

By validating the participation form for the drawing lots, the participant certifies that the entered data is correct.

The participants are informed that the data entered in the participation form for the Game is needed for their participation to be taken into account and for the allocation of the different prizes; therefore, each participant is encouraged to ensure the validity of this information.

In any case, to legitimately participate to the Game, the participant must comply with the instructions mentioned in the Game, as well as with all the instructions which will be communicated to him/her by any other means.

ARTICLE 4 – SELECTIONS OF THE WINNER
An “Instant Draw” is made at the end of each participation. Each participant will receive, on the address email communicated in the participation form, an email that contains a clickable link. The participants have to click on that link to find out their prize.

Multiple connections to the Game with a same email address are possible.

Any fraudulent participation and/or non-compliant with the rules of the Game and/or including inaccurate information will not be taken into consideration and will invalidate the entry. Any disqualified participant cannot claim any prize.

The organizing company reserves the right to put back into play the prize that would have been unduly attributed to a disqualified participant.

ARTICLE 5 – PRESENTATION OF THE PRIZES
Each participant is a winner. Each participant will randomly either win a 10% off voucher valid on the entire official store of the Moulin Rouge (without minimum amount purchase and valid thirty (30) days from the participation in the Game) or will win a prize among the following ones (while supplies last):

– Led lighting Moulin Rouge (USB) – unit price 9.90€ including tax

– Reproduction of poster “Place Blanche” of Jules Cheret – unit price 33.00€ including tax

– Set of 6 stainless steel straws – unit price 15.00€ including tax

– Dancer key ring – unit price 14.00€ including tax

The prizes’ indicated value corresponds to the public price including all taxes at the date of drafting of the Game’s rules. They are given for information purposes only and are susceptible to change. These values cannot be subject to contesting as for their evaluation by the organizing company. From the date of their participation in the Game, participants have a period of thirty (30) days in which to collect the above-mentioned prizes in store.

ARTICLE 6 – PRIZE-GIVING
The prize-giving will take place directly at the official shop “Moulin Rouge” located 11, rue Lepic, 75018 Paris (30 meters from the Moulin Rouge). For this purpose, the winners will receive all the necessary instructions on the email address provided in the participation form of the Game.

The organizing company made arrangements to have enough prizes in order to satisfy all the attributed prizes. Nonetheless, if the organizing company finds itself, for whatever reason, unable to provide the prize, it reserves the right to proceed to its replacement by another similar one. In that case, the winner cannot claim any kind of compensation from the organizing company.

The offered allocation is strictly nominative. Thus, the personal information provided by the winner in the participation form is likely to be verified by the Moulin Rouge personnel at the time that the prize is handed over to the winner. In this regard, the organizing company reserves the right to ask for a copy of the winner’s ID at the time the prize is handed over to the winner.

The prizes are neither exchangeable for another prize nor for their monetary value, and may not occasion any reimbursement, whether total or partial.

In the event a participant does not wish, or would not be able, for whatever reason, to get his/her prize in the described conditions of the present rules, he/she would lose the prize and would not be able to claim any compensation. The prize will then revert to the organizing company and will be put back into play.

ARTICLE 7 – PERSONAL DATA
It is reminded that in order to participate in the Game, the participants must provide certain personal information necessary for their participation in the Game and to the drawing lots as well as to the prize-giving.

This information is intended to the organizing company and will not be shared with its technical partners.

In accordance with the regulation no. 2016-679 of April 27th, 2016 (“Loi Informatique et Libertés“) modified, participants have a right to access, rectify, oppose, limit, and delete their personal data by sending a request in that regard to the organizing company by mail to the following address:

ARTICLE 8 – ACCESSIBILITY OF THE RULES OF THE GAME
The rules can be consulted on the official website of the Moulin Rouge at the following address:

The reimbursement of expenses from the request of the rules’ copy, can be done on the basis of a simple letter less than 20gr paid at the economic postal rate.

ARTICLE 9 – LIABILITY
The organizing company reserves the right to cancel, shorten, extend, suspend, modify or postpone the Game at any time in case of absolute necessity, without liability.

ARTICLE 10 – CLAIMS
No answer will be given to any request or claim made by phone or email regarding the interpretation of the present rules.

Any questioning or claim in relation to the Game and/or the drawing lots will have to be made in writing to the following address within thirty (30) days maximum following the opening of the clickable link revealing the prize won :

This letter will have to mention the exact date of participation in the Game, full contact details of the participant and the exact ground of contestation. No other way of contestation or claim will be taken into account.

ARTICLE 11 – JURISDICTION
The present Game is governed by French law. Any dispute that could not be settled amicably will be brought before the competent courts in Paris.
